Shopping with The Refind

What is luxury resale?

Can I put an item on hold?

As a luxury resale marketplace, all invoices at The Refind are valid for 24 hours – any unpaid invoices outside of this window will be automatically cancelled and the item returned to inventory.

We encourage all customers to review item details carefully and monitor for invoices independently when shopping.

What is your “back out” policy?

To ensure a fair and enjoyable experience for everyone in The Refind community, we have a three-strike back-out policy for live show shopping.

After three back-outs or unpaid invoices, a customer’s live show shopping privileges will be restricted for 60 days. During this time, you are still welcome to shop via Instagram DM, one-on-one with a sales associate, or in person at our Seattle flagship. Once the 60-day period has passed, full live show access is automatically reinstated.

We appreciate your understanding, as this policy exists to protect both customers and consignors during the live shopping process.

Policies

Codes of Conduct

The Refind Standard: Codes of Conduct

To protect our community and ensure The Refind remains welcoming, respectful, and safe, we uphold the following standards of conduct:

Respect and Dignity

Every person interacting with The Refind deserves kindness and respect.

  • We do not tolerate threatening, aggressive, abusive, or demeaning behavior in any form.
  • We welcome thoughtful feedback and understand that questions or frustrations may arise.
  • We ask that all concerns be communicated respectfully, directly, and in good faith.
  • Bullying, intimidation, or slighting behavior directed toward our team or community members is inconsistent with the values of The Refind.
  • We ask that everyone remember there are real people behind the screen.

Communication Expectations

Our team works to respond to inquiries promptly and with care.

  • We ask that all communication remain respectful, reasonable, and through approved channels.
  • Personal communication with team members is welcome, but timing should be respected.
  • Late-night or early-morning texts should not come with an expectation of immediate response.

Social Media & Live Shows

We want our Instagram community to remain fun, welcoming, and positive.

The following behaviors may result in removal from live shows or being blocked:

  • Inappropriate, explicit, or offensive comments
  • Bullying, harassing, or pestering behavior toward our team or community members
  • Repeated disruptive behavior after being asked to stop

We work hard to showcase inventory strategically; repeated requests to feature specific items do not help and place excessive pressure on our team.

Discrimination

The Refind is an inclusive space.

  • We do not tolerate discrimination based on race, color, age, gender identity or expression, sexual orientation, religion, national origin, disability, or marital status.
  • We respect and honor preferred names, pronouns, and forms of address for all community members.

Termination of Relationship

The Refind reserves the right to immediately terminate relationships with any consignor or customer who violates these standards. This may include denial of access to services, store access, and online community participation.

We do not take this lightly, but we will always prioritize the safety and wellbeing of our team and community.

Consignment Policy

THE REFIND: CONSIGNMENT TERMS & CONDITIONS

These Consignment Terms and Conditions govern the relationship between the consignor (the “Consignor”) and Cousin Consigned, LLC, a Washington limited liability company d/b/a “The Refind” (“The Refind”). By submitting one or more products to The Refind on a consignment basis, the Consignor agrees to these Terms and Conditions, which are incorporated by reference into the Consignment Statement between the Consignor and The Refind (together, the “SOW” or “Consignment Statement”).

These Terms and Conditions require the use of binding, individual arbitration rather than jury trials or class actions to resolve disputes — please review Section 14 carefully. This Agreement remains in effect and governs all consignment transactions between the Consignor and The Refind until either party terminates it.

CONSIGNMENT SUMMARY

Consignee: Cousin Consigned, LLC d/b/a The Refind, 3121 E Madison Street, #104, Seattle, WA 98112. Resale inquiries: resell@therefind.com.

Consignment description: The Consignor submits products to The Refind, on a consignment basis, from time to time, for review by The Refind. The Refind provides the Consignor with a personal consignor account to view the price and current status of each listed product, as well as an authentication card.

Consignment period: The consignment period for each product commences on the date it is accepted by The Refind and extends 180 days thereafter. During the consignment period, products are exclusively available for sale through The Refind.

Pricing & payment: The Refind reserves the right, at its sole discretion, to reduce the price of any product at any time to facilitate a sale. The Refind remits to the Consignor the sales price for a product, reduced by the share owed to The Refind (the “Refind Share”) and less any authentication, shipping, handling, taxes, return charges, and discounts not absorbed by The Refind (the remainder, the “Consignor Share”). The Consignor Share and Refind Share are determined by The Refind in its sole discretion, on a per-product basis.

Termination: Either party may terminate at any time on no less than ten (10) days’ prior written notice, subject to these Terms and Conditions.

Returns: During the consignment period, the Consignor may request that products be returned. The Refind will have no less than seven (7) days from the date of the request to locate and remove the product from inventory and/or the sales floor. Returns initiated by the Consignor are subject to The Refind’s standard shipping charges; returns initiated by The Refind before the end of the term ship at The Refind’s expense. For products with an agreed value exceeding $350, The Refind will make reasonable efforts to contact the Consignor before removing, returning, donating, or otherwise disposing of the product. At the conclusion of the consignment period, The Refind reserves the right to reduce the price of any unsold product or to donate it.

Authentication fee: $25.00 per product.

Payment method: Payment to the Consignor is made by direct deposit or store credit, as elected by the Consignor, within thirty (30) days of the date The Refind receives all proceeds due from the sale of a product.

1. CONSIGNMENT PRODUCTS; CONSIGNMENT PERIOD

1.1 Products. The Consignor will submit to The Refind from time to time, on a consignment basis, such quantities and types of luxury goods — such as handbags, wallets, shoes, belts, leather goods, dresses, jackets, blouses, and jewelry (collectively, the “Products”) — as inventoried and delivered to The Refind in accordance with The Refind’s shipping and collecting terms (collectively, the “Consigned Inventory”).

1.2 Shipment. The Consignor shall provide and deliver all Products to any location selected by The Refind at the Consignor’s sole and exclusive expense, FOB The Refind’s designated transfer or delivery location.

1.3 Consignment Period; No Other Sale. The consignment period for each Product commences on the date the Product is accepted by The Refind (as determined by The Refind in its discretion) (the “Commencement Date”) and ends 180 days thereafter (each, a “Consignment Period”). A Consignment Period may be extended or terminated as determined by The Refind in its sole discretion, and may be terminated by either party on no less than ten (10) days’ prior notice. If the Consignor terminates a Consignment Period, the Consignor is solely responsible for any return or shipping charges; if The Refind terminates, The Refind pays applicable shipping charges. During an applicable Consignment Period, each Product is exclusively available for sale through The Refind and may not be simultaneously listed or sold on any other platform, marketplace, or channel.

2. CONDITION AND ACCEPTANCE OF CONSIGNED INVENTORY

2.1 Condition of Inventory. The Refind will only accept Products that are authentic, clean, and that meet The Refind’s requirements for acceptance set forth herein or on the Website. Any known defects must be disclosed to The Refind upon submission. The Consignor agrees that the condition of a Product in the state received by The Refind may affect its value and sales price.

2.2 Evaluation of Products. Upon receipt, The Refind will endeavor to evaluate each Product to determine its quality and authenticity. Any Product that fails to meet The Refind’s quality and authenticity standards will be returned to the Consignor at the Consignor’s sole and exclusive expense, or may be returned at The Refind’s discretion for a fee (such as an applicable carrier’s current flat-fee rate). If any Product is found to be counterfeit, The Refind reserves the right to confiscate the Product and to provide it, along with any information (including the Consignor’s personal information) requested by any government authority tracing the origin of the counterfeit, and may terminate all SOWs with the Consignor.

2.3 Authentication Fees. All Product authentication is subject to the review and approval of The Refind in its sole discretion. All handbags are subject to an authentication fee unless the Product includes its own authentication certificate from a source approved by The Refind. The authentication fee typically ranges from $15 to $25, depending on the handbag’s value. Certain shoes and jewelry may also require authentication. The Refind will issue an authentication card upon approving a Product for sale; this card must be presented if the Consignor wishes to receive a return of the Product or to reconsign it in the future. A nonreversible replacement fee applies if the card is lost or unavailable.

2.4 Access. Upon intake and approval of a Product, The Refind will provide the Consignor access to a personal consignor account via the Website where the Consignor can view the listed price and current status of the Consigned Inventory.

3. RIGHT TO SELL CONSIGNED INVENTORY

The Consignor grants The Refind the right to receive and sell the Consigned Inventory on the Consignor’s behalf. During the Consignment Period, The Refind will use commercially reasonable efforts to make the Consigned Inventory available for purchase on The Refind’s website, located at https://therefind.com/ (the “Website”), and in its physical retail locations, and may include Consigned Inventory in its sales and promotions. The Consignor grants The Refind a perpetual, non-exclusive, royalty-free right and license to use, copy, distribute, and make derivative works of the Consignor’s brand logos, likeness, name, product images, and other intellectual property on the Website, via The Refind’s social media channels, and in any marketing materials.

4. PRICING; PAYMENT

4.1 Pricing. Due to the nature of the Products and related luxury-resale trends, all list and sale prices for any Consigned Inventory are determined at The Refind’s sole and exclusive discretion. The Refind reserves the right to adjust the price of any Product while it is in The Refind’s possession or control in order to facilitate its sale. Products may not be withheld from sale or listed at a specific price unless agreed upon in writing by The Refind.

4.2 Consignor Share. Upon the sale of a Product, The Refind remits to the Consignor the sales price for that Product, reduced by the Refind Share and less any authentication fees, shipping fees, handling fees, taxes, return charges, and discounts incurred by The Refind and not absorbed by The Refind in its discretion (collectively, the “Consignor Share”). The Consignor Share and Refind Share are determined by The Refind in its sole and exclusive discretion, on a per-Product basis.

4.3 Payment to Consignor; Store Credit. The Refind will pay the Consignor the Consignor Share within thirty (30) days of the date The Refind receives all proceeds due from the sale of a Product (the “Payment Date”), and may pay more frequently in its sole discretion, by a method determined by The Refind. If the Consignor wishes to receive store credit, the Consignor must inform The Refind in writing no less than five (5) days before the Payment Date.

5. TITLE; RISK OF LOSS; THEFT OR LOSS

All Consigned Inventory remains the property of the Consignor until The Refind sells the applicable Product. The Refind acquires no right, title, or interest in the Consigned Inventory other than the right to possess and sell it on the Consignor’s behalf. The Consignor acknowledges, assumes, and accepts all risk of loss and full responsibility for the condition of, any shortages in, and payment for all Products that may be lost, stolen, damaged, or destroyed while in The Refind’s possession or control. Dustbags, boxes, hangers, and supplementary packaging are not guaranteed to be returned, and The Refind has no liability for such materials. The Refind will use commercially reasonable efforts to maintain complete and accurate records concerning the Consigned Inventory.

If a Product is stolen or lost while in The Refind’s possession and control solely due to the negligence of a Refind employee, The Refind will treat the Product as “sold” and pay the Consignor a lost-sale fee equal to the Product’s estimated net selling price, determined solely by The Refind and paid in accordance with Section 4.3. Unless otherwise prohibited by law, this remedy is the Consignor’s sole and exclusive remedy and entire recourse against The Refind for such lost or stolen Products.

6. RETURN OF CONSIGNED INVENTORY

At any time before the termination of a Consignment Period, the Consignor may, by written notice, elect to (i) have the unsold Product returned at the Consignor’s sole and exclusive expense, or (ii) permit The Refind to donate the unsold Product to a charity of The Refind’s choosing. After the termination of a Consignment Period, if the Consignor has not elected one of these options or cannot be reached within seven (7) business days, The Refind may elect one of them in its sole discretion. If the Consignor requests return of a Product before the end of the applicable Consignment Period, The Refind may charge a fee, determined in its discretion, to cover its inventory holding cost.

7. TERMINATION

Either party may terminate the SOW at any time, for any reason, on no less than ten (10) days’ prior written notice. The Refind may terminate immediately on written notice if the Consignor breaches the SOW or the Website Terms. All accrued rights and responsibilities survive termination. Upon termination, any remaining Consigned Inventory will be returned to the Consignor at the Consignor’s sole and exclusive expense. A material breach expressly includes: (a) breach of any representation or warranty of the Consignor; (b) disrespectful, abusive, or inappropriate behavior toward any Refind employee or agent; or (c) failure to make any applicable payment when due. If The Refind terminates for material breach while a Consignment Period is in effect, The Refind may charge $25.00 per Product returned to cover its inventory holding cost; this amount does not cap any damages, and The Refind retains all rights and remedies at law and in equity.

8. REPRESENTATIONS AND WARRANTIES OF CONSIGNOR

The Consignor represents and warrants that: (i) the Consignor has good and marketable right, title, and interest in the Products, free and clear of all liens, claims, security interests, charges, and encumbrances; (ii) the Products are authentic and not counterfeit or “knock-offs,” and were not acquired through illegal activity; (iii) the Products conform in all material respects with the specifications on their labeling; (iv) the Products do not violate, infringe, or misappropriate any third party’s intellectual property or proprietary rights; (v) the Consignor’s execution of the SOW does not violate, breach, or default any other agreement; (vi) the Consignor is an independent contractor and is not and has never been an employee of The Refind; (vii) the Consignor is not economically dependent on The Refind or the expected proceeds of the SOW; and (viii) the Consignor has authority to execute the SOW, is at least eighteen (18) years old, and is bound by the SOW upon execution.

9. LIMITATION OF LIABILITY; DISCLAIMER

9.1 Limitation of Liability. THE REFIND AND ITS EMPLOYEES, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, AGENTS, SUPPLIERS, AND LICENSORS (COLLECTIVELY, THE “REFIND PARTIES”) SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND (EXCLUDING DIRECT DAMAGES), OR FOR ANY LOST REVENUES OR PROFITS, LOSS OF USE, LOSS OF COST OR OTHER SAVINGS, OR LOSS OF GOODWILL OR REPUTATION, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE (INCLUDING NEGLIGENCE AND STRICT LIABILITY), ARISING OUT OF OR RELATING TO THE PRODUCTS, ANY CONSIGNED INVENTORY, THEIR USE, OR THIS SOW.

9.2 Cap on Damages. IN NO EVENT SHALL ANY REFIND PARTY BE LIABLE, IN THE AGGREGATE, FOR ANY DIRECT DAMAGES ARISING UNDER OR IN CONNECTION WITH THE SOW IN EXCESS OF THE GREATER OF (I) $500.00 USD OR (II) THE ACTUAL SALE PRICE RECEIVED BY THE REFIND FOR THE APPLICABLE PRODUCT THAT GAVE RISE TO THE CLAIM. To the extent these limitations are not permitted under applicable law, The Refind’s liability will be limited to the greatest extent permitted by law.

9.3 Disclaimer. THE REFIND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO ANY EXPECTED PROCEEDS UNDER THE SOW, THE OPERATION OF THE SERVICES, OR ANY PRODUCTS, UNLESS OTHERWISE SPECIFIED IN WRITING. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, THE REFIND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCESSIBILITY, AND ALL WARRANTIES ARISING FROM COURSE OF DEALING AND USAGE OF TRADE.

10. INDEMNIFICATION

The Consignor agrees to indemnify, defend, and hold harmless The Refind and all Refind Parties from and against any and all claims, demands, causes of action, losses, expenses, damages, liabilities, penalties, taxes, costs (including interest, penalties, and reasonable attorneys’ fees), and judgments arising from any third-party claim relating to: (i) The Refind’s sale of any Product, including all shipping costs, fees, expenses, and taxes; (ii) any act, error, failure to act, or omission of the Consignor; or (iii) the Consignor’s breach of any term, representation, warranty, or covenant of the SOW.

11. INDEPENDENT CONTRACTOR RELATIONSHIP

The SOW is intended to create an independent-contractor relationship. Nothing in the SOW creates an employer-employee, partnership, agency, or joint-venture relationship. The Consignor is not an employee of The Refind and is not entitled to wages or benefits of any kind. All financial obligations and taxes associated with the Consignor’s business are the Consignor’s sole responsibility.

12. LICENSE FOR PROMOTION; NON-DISPARAGEMENT

The Refind grants the Consignor a limited, non-assignable, non-transferable, royalty-free license to use The Refind’s approved trademarks and service marks solely to advertise and promote the Products for sale via The Refind, in a commercially reasonable manner. Any goodwill generated inures solely to The Refind, and The Refind may revoke this license at any time in its sole discretion. In exchange, the Consignor agrees not to make or publish any statements about The Refind that could reasonably be expected to adversely affect The Refind’s reputation or that are disparaging to The Refind, its employees, agents, or business.

13. DOCUMENTS GOVERNING RELATIONSHIP

The SOW incorporates by reference The Refind’s Terms of Service and Privacy Policy, available at https://therefind.com/pages/faq (together, the “Website Terms”). The Consignor agrees that the Website Terms govern and control all of the Consignor’s use of, access to, and interaction with the Website.

14. DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER

14.1 Informal Dispute Resolution. Before initiating any action, claim, or demand against The Refind, the Consignor shall first contact The Refind directly to seek an amicable and efficient resolution.

14.2 Dispute Resolution Procedures. If the matter is not resolved, then for any controversy, claim, action, or dispute arising out of or related to any transaction, the breach, enforcement, interpretation, or validity of the SOW, or any sale of any Product (a “Dispute”), the party asserting the Dispute shall first try in good faith to settle it by providing written notice (by first-class or registered mail) describing the facts and circumstances and allowing the receiving party 30 days to respond. Notice to The Refind shall be sent to resell@therefind.com and by mail to the address above. This procedure is a condition precedent to initiating any arbitration or filing any claim.

14.3 Arbitration Agreement. To the extent the parties cannot resolve a Dispute informally, THE DISPUTE SHALL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION. The parties delegate to the arbitrator the authority to determine the arbitrability of any Dispute. All aspects of the arbitration will be strictly confidential. Before initiating arbitration, the initiating party will give at least 60 days’ advance written notice of its intent to file. Where the relief sought is $10,000 or less, the arbitration will be conducted by FairClaims (www.fairclaims.com) under its applicable rules. Where the relief sought exceeds $10,000, the arbitration will be conducted by JAMS under the JAMS Streamlined Arbitration Procedure Rules for claims up to $250,000, or the JAMS Comprehensive Arbitration Rules and Procedures for claims exceeding $250,000, excluding any rules permitting class actions. JAMS’s rules are available at jamsadr.com or by calling 800-352-5267. If permitted by JAMS, the Consignor may choose to have the arbitration conducted by electronic communication, based on written submissions, or in person in Seattle, Washington. Notwithstanding the foregoing, The Refind may bring claims outside of these procedures for: (i) infringement claims against The Refind; (ii) breach of any representation or warranty of the Consignor; or (iii) enforcement of the Consignor’s indemnification obligations.

14.4 Waiver of Class Actions and Representative Claims. All arbitrations proceed on an individual basis, not on a class or consolidated basis. Any relief must be individualized to the Consignor. Each party may bring claims against the other only in their individual capacities, and both parties waive the right to a jury trial and to assert or participate in any class action or consolidated proceeding. If a court decides that applicable law precludes enforcement of these limitations as to a particular cause of action, that cause of action must remain in court and be severed from any arbitration. This Arbitration Agreement is governed by the Federal Arbitration Act.

15. GENERAL PROVISIONS

15.1 Entire Agreement. The SOW, including these Terms and Conditions and the Website Terms, contains the full, final, and comprehensive agreement of the parties and supersedes all prior or contemporaneous negotiations, understandings, and agreements, whether written or oral. If there is any conflict between the Website Terms and the SOW as it relates to the consignor-consignee relationship, the SOW governs.

15.2 Assignment. The Consignor shall not assign the SOW or delegate any obligations without The Refind’s prior written consent, and any attempted assignment without such consent is void. The Refind may assign the SOW in its sole discretion. The SOW binds and inures to the benefit of the parties’ respective heirs, personal representatives, trustees, successors, and assigns.

15.3 Amendment. The Refind may amend the Website Terms in accordance with their terms. Unless otherwise specified, changes to the SOW may be made only in a writing signed by both parties.

15.4 Governing Law; Venue. Subject to Section 14, the SOW is governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Subject to Section 14, the parties submit to the non-exclusive jurisdiction of the state courts of Washington located in King County and the federal courts in the Western District of Washington.

15.5 Attorneys’ Fees. Each party bears its own attorneys’ fees and costs incurred in negotiating and executing the SOW; however, if any suit or action is instituted in connection with the SOW, the substantially prevailing party is entitled to recover reasonable attorneys’ fees, litigation expenses, and costs, including on appeal.

15.6 Notice. Notices under the SOW are deemed given if transmitted to the other party in person or at the address or email set forth under the SOW. Each party may change its notice address by notice to the other. The effective date of a notice is the earlier of (i) the addressee’s receipt, (ii) three days after it was sent by properly addressed registered or certified mail, or (iii) for email, confirmation of successful transmission.

15.7 Force Majeure. No failure or omission by The Refind in the performance of any obligation under the SOW will be deemed a breach or create liability if it arises from causes beyond The Refind’s control, including acts of God; virus; flu; pandemic; governmental order; shutdown or closure of any Refind retail location; fire; flood; storm; earthquake; snow; accident; war; rebellion; insurrection; riot; and invasion. The affected party will notify the other as soon as reasonably practical, and its obligations are suspended until the event is removed.

15.8 Severability; Waiver; Construction. If any provision of the SOW is adjudged unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the SOW otherwise remains in full force and effect. A party’s failure to insist on performance, or to exercise any right, is not a waiver. The parties agree the SOW was jointly drafted and will be construed in a neutral manner.

THE REFIND: CONSIGNOR POLICIES

I. GUIDELINES FOR ACCEPTED ITEMS

The Refind reserves the right to refuse any items that do not meet its standards of quality, style, authenticity, or demand.

1) Right of refusal. The Refind retains the right to refuse items that do not meet its current criteria for resale.

2) Right of return. Items that do not meet The Refind’s criteria for resale may be returned to the Consignor at the Consignor’s expense, at an applicable carrier’s current flat-fee return rate. This rate is subject to change based on the carrier’s flat-fee return rate.

3) Condition of acceptable items. All items must be clean and free of stains, damage, and repairs (tears, missing buttons, etc.). All pockets and handbags must be checked for personal items and cleaned; any personal items found will be immediately discarded. Items that do not meet these standards will be returned to the Consignor at the Consignor’s expense.

4) Authentication fee. All handbags are subject to an authentication fee of $25 (typically ranging from $15 to $25, depending on the handbag’s value) unless the handbag includes its own certificate of authentication from a source approved by The Refind, such as Entrupy or LegitGrails. If a bag was previously purchased from The Refind and still has its certificate of authentication, the Consignor is responsible for disclosing this, and re-authentication will not be required. Certain shoes and jewelry may also require authentication, as determined by The Refind.

II. HOW TO DELIVER ITEMS FOR RESALE

1) In-person consignment. Consignors in or visiting the Seattle area are encouraged to bring items in person to The Refind for evaluation of quality, style, demand, and condition. Items not taken will be returned to the Consignor.

2) Shipped consignment. Consignors who live out of state or are unable to visit in person may request a prepaid shipping label to send their items to The Refind.
